TERMS OF SERVICE

By reading this, you are acknowledging that you have read and agree to our terms of service.

PAYMENT

A deposit in the amount of 50% of the total cost is due upon receiving your invoice to guarantee your date. The remaining amount is due 7 days in advance of your event date. If the client uses equipment in excess of the service period agreed to in the invoice below, the overage in rental time will be billed to the client at the following rates:$100/hr. Payment for any overage in time must be paid before additional hours are provided. Client agrees that in addition to any and all other legal rights and remedies My Memory Booth may have. Client will pay a $50 fee for all returned checks

DATE CHANGES & CANCELLATIONS

Any requests for a date change must be made in writing at least 2 weeks in advance of the original event date. Changes are subject to photo booth availability and receipt of new service contract. If there is no availability for the alternate date, the deposit shall be forfeited and event cancelled. In the event a client cancels an event the deposits will be forfeited any cancellations occurring less than 72 hours prior to the event date shall forfeit all payments received.

PARKING

We do our best to be punctual and because of this adequate parking is very important if no street parking is available then a parking lot fee will apply. if the event is in Manhattan is below 96th st. before 7pm Mon – Sat a parking lot fee will also be added to the booking price. If both street parking and a garage is unavailable preventing My Memory Booth from performing its duties then the client agrees that My Memory Booth shall return any moneys paid by the Client, less the deposit and any other expenses, but shall have no further liability with respect to the Agreement.

EVENT FOOD SERVICE

Client agrees to provide a suitable meal (not necessarily the meal served to guests) for the onsite attendant if contracted coverage extends through a meal service or coverage is 4 hours or longer

DAMAGE TO MY MEMORY BOOTH EQUPIMENT

Client acknowledges that they shall be responsible for any damage or loss to the My Memory Booth equipment caused by any misuse of the equipment by Client(s) or its guests or theft.

USE OF IMAGES

The client gives My Memory Booth Inc. permission to use images taken at their event to be used on My Memory Booth website, social media pages and for advertising and promotional purposes My Memory Booth will not use any images that are deemed unsuitable on their website or for advertising purpose and will not use any content that may be personally damaging to the persons(s).

INDEMNIFICATION

You agree to indemnify and hold My Memory Booth Inc, its employees, affiliates, and representatives, harmless from and against any and all claims, losses, damages, liabilities, expenses, including reasonable attorney’s fees, arising from your violation of reproducing, coping, transmitting, distributing, or otherwise exploiting the images or photographs in any way not authorized by My Memory Booth Inc. This obligation will survive the termination of the agreement.

Force Majeure

If My Memory Booth or its assigns cannot perform this Agreement due to inclement weather, a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, parking issues, fire, terrorism or other causes beyond the control of the parties, then My Memory Booth shall return any moneys paid by the Client, less the deposit and any other expenses, but shall have no further liability with respect to the Agreement. This limitation of liability shall also apply in the event that photographic materials are damaged, lost through camera malfunction, compact flash card malfunction, or otherwise lost or damaged without the fault on the part of My Memory Booth. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals
